Yritykset: näin anot Allergiatunnusta

ALLERGIATUNNUKSEN KÄYTTÖOIKEUDEN anominen

Allergiatunnus ohjaa yrityksiä terveysvastuulliseen valmistamiseen. Allergiakriteerit ovat tarkasti määritelty kullekin tuoteryhmälle. Tunnuksen myöntää Allergia-, Iho- ja Astmaliitto ry toteuttaen käsittelyt yhteistyössä ulkopuolisten asiantuntijoiden ja tutkijoiden kanssa. 

Allergiatunnuksen käyttöoikeutta anotaan vapaamuotoisella käyttöoikeushakemuksella, jonka mukana tulee toimittaa seuraavat tiedot:

• yritystiedot (nimi, osoite, y-tunnus, yhteyshenkilö, sähköposti, www)
• yrityksen ja tuotteiden kuvaus (historia, toimiala, tuotteet joille anotaan tunnusta, tuotteiden jälleenmyyntipisteet ja tuotteiden liikevaihtoarvio vuodessa)
• tuotetiedot (100% koostumustiedot: INCI-nimi, CAS-numero sekä pitoisuustieto) ja kustakin tuotteesta mallikappaleet (1-2kpl) 
• erilaiset testitulokset ja sertifikaattikopiot
• markkinointimateriaalit, käyttöohjeet (tekniset laitteet)

Allergiatunnuksen käyttöoikeushakemus ja liitteet toimitetaan sähköpostilla siten, että kukin tiedosto on pdf-muodossa ja nimetty sen mukaan, mitä tietoa liite tuotteesta kertoo. 

ENGLISH / Applying for the Right to Use the Allergy Label

The Allergy Label guides companies toward health-conscious manufacturing. Allergy criteria are precisely defined for each product category. The label is granted by the Allergy, Skin and Asthma Federation in cooperation with external experts and researchers. To apply for the right to use the Allergy Label, submit a free-form application along with the following information:

• Company details (name, address, business ID, contact person, email, website)
• Description of the company and products (history, industry, products for which the label is requested, retail locations, and estimated annual turnover for these products)
• Product details (100% composition information: INCI name, CAS number, and concentration data) and sample products (1–2 pieces of each)
• Various test results and copies of certificates
• Marketing materials and user manuals (for technical devices)

The application and attachments must be sent by email. Each file should be in PDF format and named according to the information it contains about the product.

Asiantuntijakäsittelymenetelmä, aikataulu ja kustannukset

Allergiatunnuksen käyttöoikeushakemuksen asiantuntijakäsittely kestää 4-6 viikkoa ja käsittelykulut ovat 250€/h, maksimissaan 1000€. Käsittelyyn voi lähettää useamman tuotteen kerrallaan. Puoltavien lausuntojen myötä myönnetään tuotteille Allergiatunnuksen käyttöoikeus Allergiatunnuksen käyttöoikeussopimuksella. Sopimus on voimassa kerrallaan 2 vuotta ja Allergiatunnuksen käyttöön liittyvä käyttöoikeusmaksu määräytyy tuotteiden allergianäkökulman merkittävyyden ja tuotteiden liikevaihtoluokan mukaan seuraavasti.

Liikevaihto = käyttöoikeusmaksu

• alle 50.000€/v = 2000€/v
• alle 200.000€/v = 3700€/v
• alle 850.000€/v = 5000€ – 10.000€ /v.
• alle 1,7M€/v = 8.000€ – 15.000€/v
• alle 3,5M€/v = 12.000€ – 23.500€/v
• yli 3,5M€/v = 15.000€ – 30.000€/v
• yli 10M€/v = 23.500 – 45.000€/v

Kaikkia tuoteryhmiä koskee tuoteryhmäkohtaiset kriteerit, jotka dokumentoidaan parhaillaan asiantuntijoiden kanssa ja ne löytyvät jatkossa Tuotteet-välilehdiltä. Ennen dokumenttien valmistumista, tiedustele kriteereistä yhteystiedot-välilehden kautta. Tuotteiden ärsyttävyyttä ja herkistävyyttä tai muuta etua allergisille arvioidaan aina allergianäkökulmasta. Allergiatunnuksen käyttöoikeuden myöntämismenettely on säilynyt samankaltaisena sen perustamisesta lähtien vuodesta 1995. 

ENGLISH / Expert Review Process, Timeline, and Costs

The expert review of the Allergy Label usage application takes 4–6 weeks, and the processing fee is €250/hour, up to a maximum of €1,000. Multiple products can be submitted for review at the same time.

Upon receiving favorable expert opinions, the right to use the Allergy Label is granted through an Allergy Label Usage Agreement. The agreement is valid for 2 years, and the annual usage fee depends on the significance of the product from an allergy perspective and its turnover category as follows:

• Under €50,000/year → €2,000/year
• Under €200,000/year → €3,700/year
• Under €850,000/year → €5,000–€10,000/year
• Under €1.7M/year → €8,000–€15,000/year
• Under €3.5M/year → €12,000–€23,500/year
• Over €3.5M/year → €15,000–€30,000/year
• Over €10M/year → €23,500–€45,000/year

Allergiatunnuksen käyttöoikeushakemuskäsittelyiden eteneminen

• Allergiariskikartoitus: käsittelyprosessi, jossa kartoitetaan tuotteiden allergianäkökulma, arvioidaan tuotteiden näytteet ja koostumukset ja karsitaan ulkopuoliseen varmennuskäsittelyyn soveltumattomat tuotteet, jotka eivät läpäise kriteerejä jo alustavassa arvioinnissa.
• Ulkopuolinen asiantuntijakäsittely: jokainen tuote, jota ei hylätä allergiariskikartoituksessa, lähetetään ulkopuoliseen varmennuskäsittelyyn. Käsittelyyn osallistuvat eri alan asiantuntijat riippuen käsiteltävistä tuotteista. Asiantuntijoina toimivat ihotautilääkärit, kemistit, allergologit, kosmetiikan allergia-asiantuntijat, sisäilman-alan asiantuntijat ja tutkijat, lasten lääkärit sekä elintarvikeasiantuntijat. Tuote hylätään, jos missään sen käsittelyprosessin vaiheessa tuotteen allergiaturvallisuus kyseenalaistuu. Hylkäys tapahtuu myös mikäli tuotteen ainesosista ei ole tarvittaessa riittävästi tietoa tai tuotteen raaka-aineet/materiaalit osoittautuvat ulkopuolisessa varmennuskäsittelyssä allergiariskin aiheuttajiksi. Ulkopuoliset asiantuntijat varmentavat aina Allergiatunnuksen käyttöoikeuden myöntämisen ja antavat hyväksynnälle/hylkäykselle lääketieteellisen perustelun. 

Allergiatunnus toteuttaa yhteistyötä myös puolueettomien tutkimuslaitosten ja asiantuntijatahojen kanssa, kuten VTT, Työtehoseura, Ruokavirasto, Kuluttajavirasto, Teknokemianyhdistys, Työterveyslaitokset ja muut tarvittavat tahot tarpeiden mukaan.

ENGLISH / Progress of the Allergy Label Application Process

Allergy Risk Assessment:
This is the initial stage of the process, where the allergy-related aspects of the products are evaluated. Product samples and compositions are reviewed, and any products that do not meet the criteria during this preliminary assessment are excluded from further verification.

External Expert Review:
Every product that passes the allergy risk assessment is sent for external verification. The review involves specialists from various fields depending on the product type. Experts include dermatologists, chemists, allergologists, cosmetic allergy specialists, indoor air quality experts and researchers, pediatricians, and food specialists.

A product will be rejected if its allergy safety is questioned at any stage of the review process. Rejection also occurs if there is insufficient information about the product’s ingredients or if raw materials/components are identified as allergy risks during external verification.

External experts always validate the granting of the Allergy Label usage rights and provide a medical justification for approval or rejection.

Allergiatunnus® logo

Allergiatunnus on suojattu ja rekisteröity tavaramerkki. Logossa esiintyy kumpupilvi, pääskynen sekä teksti ”Yhteistyössä Allergia-, Iho- ja Astmaliiton kanssa”. Logosta käytetään nimitystä Allergiatunnus. Tunnuksen käyttöön on aina saatava tapauskohtainen lupa, jonka myöntää Allergia-, Iho- ja Astmaliitto ry. Kyseessä on eri merkki kuin Allergia-, Iho- ja Astmaliitto ry:n yrityslogo, jonka käyttö on ehdottomasti kielletty virallisen Allergiatunnuslogon asemasta. Logot ja käyttöohjeet värimäärityksineen saa Allergia-, iho- ja astmaliitosta. 

Muiden maiden allergiamerkinnät, -logot ja -tunnukset

Kansainvälisiä ja kaupallisia allergiamerkkejä on olemassa maailmalla erilaisia. Merkeillä on maakohtaiset käsittelymenetelmät, kriteerit ja erilaiset käyttöoikeussopimukset. Tästä syystä muiden maiden allergiamerkki ei ole vastaava kuin Suomen Allergiatunnus. Merkit saattavat harhaanjohtavat kuluttajaa ja saattavat sisältää allergiaa aiheuttavia ainesosia ja hajusteita, joita Suomessa asiantuntijat eivät hyväksy allergiakriteereissä. Markkinoilta saattaa olla merkkejä, jotka poikkeavat oleellisesti Allergiatunnuksesta ja eivät perustu puolueettomasti tutkittuun asiantuntijatyöhön. Mikäli yritys on saanut allergiamerkinnän jossain muussa maassa ja anoo Suomen Allergiatunnusta, saattaa tämä nopeuttaa yrityksen hakumenettelyä Suomessa. Euroopan laajuista allergialogoa ei ole käytössä, sillä etelä-euroopan kriteerit poikkeavat oleellisesti pohjoismaiden kriteereistä. Syynä kriteerien eroavaisuuteen on kansalliset allergiat ja herkkyydet. Suomessa atooppisesta ihosta kärsii 30% väestöstä, kun vastaavasti etelä-euroopassa luku on pieni.

Allergiatunnuksen väärinkäyttö

Allergiatunnuksen väärinkäyttö on kuluttajien harhaanjohtamista. Tunnuksen luvattomasta käytöstä sakotetaan Allergiatunnuksen käyttöoikeusmaksuluokkien mukaan. Jos Allergiatunnusta käytetään hyödyksi tuotteiden markkinoinnissa käyttöoikeussopimuskauden päättymisen jälkeen sopimuksessa mainitut ehdot huomioituna, eikä huomautuksesta huolimatta lopeteta harhaanjohtavaa markkinointia (koskee myös yhtiön jälleenmyyjiä), sakotetaan väärinkäytöksestä sopimuksessa mainitun ehdon mukaisesti.

ENGLISH / Allergia Label -logo

Allergiatunnus is a protected and registered trademark. The logo features a cumulus cloud, a swallow, and the text “In cooperation with the Allergy, Skin and Asthma Federation.” The logo is referred to as Allergiatunnus. Permission for its use must always be obtained on a case-by-case basis from the Allergy, Skin and Asthma Federation. This is a different mark from the Federation’s corporate logo, which must never be used in place of the official Allergiatunnus logo. Logos and usage guidelines, including color specifications, are available from the Allergy, Skin and Asthma Federation.

Allergy Labels, Logos, and Marks in Other Countries

There are various international and commercial allergy marks worldwide. These marks have country-specific handling methods, criteria, and different licensing agreements. For this reason, an allergy mark from another country is not equivalent to Finland’s Allergiatunnus. Such marks may mislead consumers and may include ingredients or fragrances that Finnish experts do not approve under allergy criteria. Some marks on the market differ significantly from Allergiatunnus and are not based on impartial, expert-reviewed research. If a company has obtained an allergy mark in another country and applies for Finland’s Allergiatunnus, this may speed up the application process in Finland. There is no Europe-wide allergy logo because criteria in Southern Europe differ significantly from those in the Nordic countries. The reason for these differences lies in national allergies and sensitivities. In Finland, 30% of the population suffers from atopic skin, whereas in Southern Europe the figure is much smaller.

Misuse of Allergiatunnus misleads consumers. Unauthorized use of the mark is subject to penalties according to the Allergiatunnus licensing fee categories. If Allergiatunnus is used in product marketing after the licensing agreement has expired—taking into account the terms specified in the agreement—and misleading marketing continues despite a warning (including by the company’s resellers), penalties will be imposed in accordance with the relevant contractual terms.
